For any questions, comments or concerns regarding this information note, please contact the Data Controller F.lli De Cecco di Filippo Fara San Martino  S.p.A. (hereinafter also “De Cecco”), with headquarters in the industrial area 66015, Fara San Martino (CH).

The Data Controller has appointed as data protection officer (DPO), pursuant to art. 37 of European Regulation 679/2016 on privacy, Attorney in Law Giulio Maria Garofalo E-mail: [email protected].

General Information

Cookies are small files containing portions of code installed inside the browser in order to assist the website owner to provide the service in relation to the purposes described. Each cookie is unique to the user’s web browser.

Some of the cookies’ functions can be delegated to other technologies. In this information note, with the term “cookie” we refer both to cookies, in the strict sense of the word, and to all similar technologies.

Some purposes of cookie installation may require the consent of the User. If the installation of cookies is based on consent, this can be freely revoked at any time by following the instructions contained in this information note.

Italian legislation (Article 122 of Legislative Decree no 196/03 “Privacy Code”) has implemented a European Directive that requires managers of websites which use cookies or other monitoring technologies to inform the user about the types of cookies used by the website.

The Provision of the Italian Authority for the protection of personal data no 229 dated 8 May 2014, published on the O.G. no 126 dated 3 June 2014, distinguishes cookies in two general categories: “technical” and “profiling” cookies.

Technical cookies

They are used for the sole purpose of “transmitting information through an electronic communications network, or as is strictly necessary for the provision of an information service as explicitly requested by the subscriber or user” (see Art 122, paragraph 1, of the Data Protection Law).

They are usually installed directly by the owner or operator of the website and can be further distinguished in:

  • browsing or session cookies: they guarantee the normal navigation and use of the website (allowing, for example, to make a purchase or to login to access restricted areas); they are de facto necessary for the correct operation of the website;
  • analytics cookies: they are similar to technical cookies if used directly by the site operator to collect information, in aggregate form, concerning the number of users and how these visit the website, to improve the website’s performance;
  • functionality cookies: they allow the user to browse according to a series of selected criteria (for example, the language, the products selected for purchase) in order to improve the service provided. The prior consent of users is not required to install these cookies (more information in the Cookie management paragraph below).

The prior consent of users is not required to install these cookies.

Profiling cookies

They are needed to create profiles concerning the user and are used to send advertising messages consistent with the preferences expressed by the same while browsing the internet.

Both European and Italian legislation provides that the user must be adequately informed as concerns their use and must provide valid consent due to the particular invasiveness that such devices can have in the private sphere of users.

The Provision of the Italian Authority for the Protection of Personal Data distinguishes these cookies from the point of view of the subject who operates as the data controller of the personal data collected by the cookie:

  1. First-party cookies: these are cookies managed by the website controller. For these cookies, the website data controller must provide the information note. It is also up to the latter to specify the methods for potentially blocking the cookie.
  2. Third-party cookies: these cookies are managed by a third party other than the website data controller. For these cookies, the third party must provide the information and the indication of how to block the cookie, while the website controller is obliged to indicate the link to the third party website where such elements are available.

For both types of cookies (first-party or third-party) collecting the consent, which is necessary should these be profiling cookies, is carried out through a specific banner on the website’s home page.

You can manage these cookies in any case through your browser settings (follow the instructions given further on in the section “Cookie Management”.
